and maintains all documentation required by U.S.C.
2257 regarding all persons, whether real or fictitious.
The term Hennessie is derived from a description used
in the adult entertainment industry ( derived from the
term 'Cream Pie' ) which is a non-Trademarkable term
as defined in Chapter 800 - TMEP (Trademark Manual of
Examining Proceedure), Second Edition, Revision 1.1
which clearly states, "The following are substantive
grounds for refusal. (referring to refusal of the issuance
of a Trademark) Registration may be refused on the ground
that the mark: '8. is merely descriptive or deceptively
misdescriptive of the applicants goods and/or services,
when used on or in connection with them (see 15 U.S.C.
1052(e)(1); TMEP 1209 et seq.).
